El tweet del “trabajo de tiempo completo” de Elon Musk fue divertido, pero reveló una verdad brutal que la mayoría de la gente no admite

Nuestra historia comienza con algo que Musk tuiteó en respuesta a un informe de un periodista sobre el litigio SpaceX-Amazon sobre los esfuerzos para construir y lanzar satélites con conectividad a Internet de banda ancha.

  • En 2019, Amazon anunció sus planes de ingresar al negocio de satélites de Internet a través de su subsidiaria Kuiper Systems LLC y solicitó a la Comisión Federal de Comunicaciones que operara la compañía en un espectro de frecuencia dedicado.
  • Sin embargo, la FCC había otorgado licencias para este espectro a empresas como SpaceX, OneWeb y otros jugadores hace muchos años. SpaceX y los demás rechazaron la solicitud de Amazon. Esto inició una complicada batalla legal y regulatoria ante la FCC, que continúa hasta el día de hoy.

Eso nos lleva al tweet de Musk, que se produjo en respuesta a un informe de Michael Sheetz que cubría el espacio para CNBC:

“Presentar una acción legal contra SpaceX es * en realidad * su trabajo de tiempo completo”.

Me reí a carcajadas por una segunda lectura de esto. Aunque Jeff Bezos solo se menciona una vez (y ni siquiera por su nombre) en los documentos legales de la FCC que puedo encontrar, todos sabemos a quién se refiere Musk aquí. ¿A la derecha? Al menos eso pienso.

Y a veces es divertido ver a Musk Bezos trollear en Twitter. Realmente parece estar disfrutándolo. Sin embargo, creo que el tweet también contiene una verdad brutal, caótica y fea.

Suponiendo que esta es una excavación muy poco velada en Bezos, todos sabemos que el trabajo de tiempo completo de Bezos no lo es. Sí, en serio utilizando el sistema legal para defender a Kuiper y, a menudo, contra SpaceX. (Está ocupado estos días montando misiles y dirigiendo al presidente de la junta).

Pero es alguien Trabajo.

¿De quién es el trabajo? Bueno, en su presentación más reciente, SpaceX dice que Amazon “trae habitualmente hasta seis cabilderos y abogados a sus numerosas reuniones con la Comisión a través de SpaceX”.

Mientras tanto, los SpaceX son Satellite Policy Director, quien firmó la última presentación, es un abogado consumado que anteriormente se desempeñó como asesor principal del ex presidente de la FCC y del Congreso.

Y me atrevo a decir, incluso si a la mayoría de la gente no le gusta admitirlo, que nuestro sistema funciona así. De hecho, me atrevería a decir que, en general, es algo bueno.

Porque estamos hablando del lanzamiento de muchos miles de satélites comerciales, una escala sin precedentes, junto con el uso innovador del espectro de frecuencias. Es difícil siquiera pensar en los efectos de segundo y tercer orden junto con el tamaño de la oportunidad.

Por lo tanto, incluso las personas que desean menos gobierno en general podrían estar de acuerdo en que, en este caso, probablemente tenga sentido tener un marco regulatorio sólido.

Por supuesto, puede ser complicado, retrasar, molestar y frustrar. Pero, ¿Cual es la alternativa?

En el extremo, sería una libertad total para todos, donde cualquier empresa podría desestabilizar a cualquier otra empresa y, paradójicamente, evitar que las mejores empresas compitan siquiera.

Los lectores veteranos sabrán que estoy deseando que SpaceX o OneWeb o Amazon o alguna otra compañía, realmente no sé cuál, lograr el objetivo. Lleve el acceso a Internet de banda ancha de alta velocidad a los lugares más remotos.

Pero aun así reveló algo importante.

La gente se ha estado quejando de los abogados desde Shakespeare. Maldita sea, me quejo de ella y yo mismo soy un abogado no practicante.

    • Then, this week, SpaceX filed a response that complained, among other things, about how many objections Amazon has filed against SpaceX. As its counsel wrote:

    "Amazon's recent missive is unfortunately only the latest in its continuing efforts to slow down competition ... while neglecting to resolve the Commission's concerns about Amazon's own non-geostationary orbit ('NGSO') satellite system. n ... n While Amazon has waited 15 months to explain how its system works, it has lodged objections to SpaceX on average about every 16 days this year."
    n With that, we reach Musk's tweet, which came in response to a report by Michael Sheetz, who covers space for CNBC: n
    "Filing legal actions against SpaceX is *actually* his full-time job."
    n n I laughed out loud for a second when I read this. Even though Jeff Bezos is only referred to once in the FCC legal documents that I can find (and not even by name), we all know who Musk has to be referring to here. Right? At least I think so. n And it's amusing to watch sometimes as Musk trolls Bezos on Twitter. He really seems to enjoy it. However, I think there's also a brutal, messy, ugly truth contained within the tweet. n Assuming this is a very thinly-veiled dig at Bezos, we all know that Bezos's full-time job is not really to use the legal system to advocate for Kuiper, and oHeaven32en against SpaceX. (He's busy these days riding rockets, and executive-chairmaning.) n But, it is somebody's job. n Whose job? Well, within its recent filing, SpaceX says Amazon "routinely brings as many as six lobbyists and lawyers to its many meetings with the Commission about SpaceX." n Meanwhile, SpaceX's director of satellite policy, who signed the latest filing, is an accomplished lawyer who previously worked as a senior advisor to the former FCC chairman and in Congress. n And that, I venture to say -- even though most people don't like to admit it -- that this is exactly how our system is designed to work. I'd even go so far as to say it's a good thing, all things considered. n Because, we're talking about the launching of many thousands of commercial satellites -- an unprecedented scale -- along with the groundbreaking use of frequency spectrum. It's difficult even to think through the second and third-order effects, along with the size of the opportunity. n So, even people who want less government overall might agree that in this case, it probably makes sense to have a strong regulatory framework in place. n Granted, it can be messy, delaying, annoying, and frustrating. But what's the alternative?  n At the extreme, it would be a complete free-for-all, in which any company could interfere with any other company, and which paradoxically might discourage the best companies from competing in the first place. n Long-time readers will know that I am eager for SpaceX, or OneWeb, or Amazon, or some other company--I'm truly agnostic as to which one--to achieve the goal of  bringing high-speed broadband Internet access to the most remote places. n I've seen first-hand how a lack of broadband access can hold rural areas back in the 21st century. So, I think I understand the urgency. n Now, I don't necessarily think Musk was trying to make all these points about the regulatory state and the legal system and innovation. I think he's more likely just taking the opportunity to roast Bezos again. n But he's nevertheless revealed something important. n Since the time of Shakespeare, people have complained about lawyers.
